The deadline for HITECH compliance is December 31, 2010.

The Health Information Technology for Economic and Clinical Health Act – HITECH Act for short – has three critical provisions for physician practices and healthcare providers:

1.
All physician practices and healthcare providers in the U.S. are required to implement a certified electronic medical records system by the end of 2010.

2.
Practices that do not implement certified EMR systems by the deadline can be assessed a penalty of 1% of their Medicare/Medicaid payments during the first year of non-compliance. The penalty can rise in subsequent years if compliance is not attained.

3.
Practices qualifying under the HITECH Act's "meaningful use" guidelines will be eligible for federal incentive funds of $40,000 to $65,000 to help pay for the cost of compliance.
